Getting medical care. Figuring out how to get to work. Dealing with the insurance company. Getting a vehicle repaired or replaced. What most people are not thinking about is evidence. The problem is that evidence does not always stick around. If you have been injured because of someone else’s actions, getting a **personal injury attorney** involved early can matter because some of the evidence that could help your case may only be available for a limited amount of time. As Mario puts it: “Cases change when you have the evidence that you need, and most of the time you have to get it right away.” ## **Evidence Can Disappear Faster Than You Think** One of the easiest examples is surveillance footage. Let’s say you are involved in a crash near a gas station, restaurant, business, apartment building, or intersection. There may be a camera nearby that captured exactly what happened. That footage could potentially show who had the green light, how fast a vehicle was traveling, where the vehicles were positioned, or what happened immediately before the crash. But that does not mean the footage will still be there months later. Many video systems continuously record over older footage. If nobody identifies that footage and takes steps to preserve it, potentially useful evidence can disappear. As Mario explains: “That’s what an attorney’s job is, to start to do that investigation, figure out where you can get your evidence and preserve it.” The injured person usually has no reason to know all of this immediately after an accident. You should be able to focus on your recovery while your attorney focuses on building and protecting the case. ## **What Is a Preservation Letter?** When we believe another person, company, or organization may have important evidence, an attorney may send a written notice asking that the evidence be preserved. For example, if a business has surveillance footage that may show how an accident occurred, we may want to notify that business as quickly as possible that the footage could be relevant to a potential claim. The goal is simple: identify important evidence before it disappears and take the appropriate steps to preserve it. Waiting too long can make that much harder. ## **What Happens if Evidence Is Destroyed?** This is where the legal concept of **spoliation of evidence** can become important. Generally speaking, spoliation involves the loss, destruction, alteration, or failure to preserve evidence that may be relevant to litigation. Exactly how a court handles an evidence-preservation issue depends on the facts and applicable law.
